SmartBrick provides construction services including:
- Residential home construction (Row houses, Bungalows, Villas)
- Building development projects
- Group booking plot development
- Engineering supervision and quality assurance
- Design and architectural services
- Project tracking and management
3. Project Agreement and Booking
3.1 Booking Process
- Initial consultation and site assessment
- Detailed project proposal and cost estimation
- Booking confirmation with advance payment
- Detailed architectural and structural plans
- Construction commencement
3.2 Payment Terms
- Booking amount: 10% of total project cost
- Payments linked to construction milestones
- Escrow payment system for customer protection
- No hidden costs or price escalations
4. Construction Timeline
Project completion timelines:
- Standard projects: 6-12 months
- Complex projects: 12-18 months
- Timeline depends on project scope, weather conditions, and regulatory approvals
- Zero delays policy with penalty clauses for contractor delays
5. Quality Assurance
SmartBrick guarantees:
- 470+ quality checkpoints throughout construction
- Use of ISI certified materials only
- Compliance with local building codes and regulations
- Regular third-party quality inspections
- Vastu Shastra compliance (where requested)
6. Warranty Terms
6.1 Structural Warranty
- Silver Package: 5 years structural warranty
- Gold Package: 7 years structural warranty
- Platinum Package: 10 years structural warranty
6.2 Warranty Coverage
- Structural defects and foundation issues
- Major electrical and plumbing systems
- Waterproofing and seepage issues
- Excludes normal wear and tear
7. Customer Responsibilities
Customers are responsible for:
- Providing clear and accurate project requirements
- Obtaining necessary approvals and permits
- Ensuring site accessibility for construction
- Timely payment as per agreed schedule
- Providing feedback during construction phases
8. Modifications and Changes
Project modifications:
- Changes must be requested in writing
- Additional costs will be communicated upfront
- Timeline adjustments may apply for major changes
- No changes allowed after 50% construction completion
9. Force Majeure
SmartBrick shall not be liable for delays or failures due to:
- Natural disasters, extreme weather conditions
- Government regulations or policy changes
- Labor strikes or material shortages
- Pandemic or health emergencies
- Other circumstances beyond our reasonable control
10. Dispute Resolution
In case of disputes:
- Initial resolution through direct communication
- Mediation through mutually agreed mediator
- Arbitration as per Indian Arbitration Act
- Jurisdiction: Courts of Pune, Maharashtra
11. Limitation of Liability
SmartBrick's liability is limited to:
- Direct damages related to construction defects
- Maximum liability not exceeding project contract value
- No liability for indirect or consequential damages
- Claims must be made within warranty period
12. Intellectual Property
All designs, plans, and proprietary methods remain the intellectual property of SmartBrick unless explicitly transferred to the customer.
13. Termination
Either party may terminate the agreement:
- With 30 days written notice
- Immediate termination for material breach
- Settlement of dues as per work completed
- Return of advance payments (minus work done)
14. Governing Law
These terms are governed by the laws of India and subject to the jurisdiction of courts in Pune, Maharashtra.
